The San Jose Police Department is asking for the public’s help in locating two suspects involved in a Lottery Scam.

On September 12, 2012, at approximately 1630 hrs, an elderly female was swindled out of her lifesavings in a Lottery Scam. The victim was walking in the vicinity of 24th St/San Antonio when she was approached by a Hispanic Male Adult (S-1) who asked her for directions to a business. As the dialogue continued, a second suspect (S-2) seemed to overhear the conversation and told the victim that he was familiar with the business. (S-2) asked the victim to help (S-1). (S-2) had a dark gray mini-van parked adjacent to where they were standing and (S-1) grabbed the victim by her shoulders and pushed her towards the van. (S-2) later pulled out what looked to be a lottery ticket from his wallet. (S-2) said it was worth a large amount of money. (S-2) called the California Lottery Commission over speaker phone. The victim heard a female on the phone explaining to (S2) that in order to cash the ticket; the Lottery Commission needed some collateral and also needed an individual who was a U.S. citizen. The victim believed what she heard and gave (S-2) a large amount of money. The victim was later dropped off in the area of S. King Rd/Virginia Ave. Both suspects drove away from the area.

Anyone with information regarding this theft is urged to contact Detective Mendoza #3547 in the San Jose Police Department’s Robbery Unit at (408)277-4166 or via email at 3547@sanjoseca.gov.

A 17-year-old boy was shot and killed Tuesday evening as he walked along a San Jose sidewalk in front of an elementary school — apparently hit with multiple bullets fired by someone who drove by in a vehicle, neighbors say.

The shooting happened at 6:20 p.m. in the 900 block of Owsley Avenue, in front of Rocketship Mosaic Elementary School.

A neighbor who was outside when it happened first heard two shots, followed by a pause and then three more.

“I ran up the street, and this lady was holding his head up so he wouldn’t choke on his blood,” said the neighbor, who declined to be identified.

He said it appeared that at least two shots struck the boy in the chest, and that his breathing was labored and blood was coming from his mouth.

San Jose police said the boy was struck multiple times and pronounced dead at the scene.

The motive and circumstances remain under investigation, police said, and no arrests have been made. No one else was injured in the shooting.

Hours after the shooting, a red baseball cap lay next to an evidence marker at the scene of the shooting in an area residents said is known for gang activity.

One called it a “good neighborhood, but with some bad people,” and a man who gave his name only as “Robert” said that after living in the area since 1983 he’s become desensitized to violence.

“There’s always stuff happening, and after a while, it’s just like, you can’t keep track of it anymore,” he said.

San Jose police Lt. Rick Weger said they are still interviewing multiple witnesses and would not divulge suspect or vehicle descriptions at this time. He said it appeared that a handgun was used and that a vehicle was involved.

He said it was too early to say whether it might be gang-related.

It was the city’s 19th homicide, on the tail of the shooting of Thai Vu, 25, of Milpitas, early Friday morning at the Happioke karaoke bar, on Senter Road about two miles away from Tuesday’s slaying. Three Union City teens were arrested in that case.

The city’s 16th homicide happened a little more than a mile and a half from the shooting, on Virginia Avenue off S. King Road, when 16-year-old Ruben Zamora was gunned down in late May.

Before that, Ricky Jacques, 18, was shot and killed just a block away near Story Road and Lucretia Avenue on May 16.

Those three homicides are believed to be gang related.

Anyone with information is asked to call San Jose homicide investigators at 408-277-5283. Anonymous tips can be made to Silicon Valley Crime Stoppers at 408-947-7867.

According to San Jose police, officers responded to the 1800 block of Sarasota Way at about 4:00 p.m. Saturday on a report of a person being attacked. Upon arrival, officers located 22-year-old Joseph Michael Robidoux-Cruz suffering from multiple stab wounds and blunt force trauma. Attempts to resuscitate the victim were unsuccessful and he was pronounced dead at the scene.

Witnesses told police that a confrontation had occurred between the victim and three suspects. Police learned from witness accounts that the suspects were traveling in a white Acura when they spotted the victim walking and gave chase before attacking Robidoux-Cruz.

Preliminary investigation determined that the suspects were Alain Calvillo, 20, Filiberto Barreto Lopez, 20, and Francisco Bartolo Chavez, 23, and the suspect vehicle was identified by patrol officers.

The trio was arrested at about 11:15 p.m. in the area of South King and Story roads. Police say Calvillo was driving the Acura at the time of his arrest, while Lopez and Bartolo were in another vehicle.

According to authorities, the brutal attack was gang-motivated. Calvillo was booked into Santa Clara County Jail on suspicion of being an accessory to the homicide. Lopez and Chavez were charged with suspicion of homicide.

Robidoux-Cruz’ death marks San Jose’s 7th homicide of 2012. The case remains under investigation and anyone with information is urged to contact Detective Sgt. Steven Bustillos or Det. Jaime Jimenez of the SJPD’s Homicide Unit at (408) 277-5283.
